Commissioner's Contract

__By commissioning me and submitting payment, you have read and agreed to the terms listed below. __

SECTION I. IMAGE COPYRIGHT

  1. I, the artist, retain full and exclusive rights to the original artwork. The client may not claim it as their own or use it for anything other than personal use.

  2. All commissioned artwork is for noncommercial purpose only. Redistribution of my artwork for use in printed merchandise or as promotion of goods, NFT's, services or social media pages is prohibited. However, if you are interested in purchasing the rights to an artwork, you are welcome to ask me about it.

  3. Conditions for Reposting - The client has my permission to repost the artwork wherever they would like, as long as proper credit is given (a link back to my Twitter page) and my watermark/signature remains intact and unaltered.

  4. Altering my artwork in any way without asking for permission before hand, with the exception of cropping/resizing the image for an icon or other use is prohibited.

  5. If these terms are broken, you will be privately blacklisted from commissioning me and reported.

SECTION II. PAYMENT INFORMATION

  1. Payment may be done though Paypal, Venmo, or Zelle, and must be paid 100% upfront. I will not start working on the commission before payment. Links to such will be provided once order is placed.

  2. It is the commissioner's responsibility to tell me when the payment has been sent. Sometimes a payment will not fall through and I won't know about it.

  3. 100% refund can be given only if the piece has not been started yet. If it's in the sketch/planning stage, a 50% refund may be given. Once outlining process has started, there will be no refunds.

__SECTION III. CANS AND CANNOTS

  1. Can do - OC's, anthro, humanoids, suggestive art, fanart, simple designs

  2. Can't do - nsfw, mecha, vehicles, complex designs and backgrounds

  3. You must be over the age of 18 to commission adult content. This includes any suggestive content

  4. Additional Characters are half the base price.

  5. I have the right to refuse to accept any commissions.

__SECTION IV. THE PROCESS

  1. I will be transparent with you throughout the entire process via DM's, asking any questions that would help me complete your order, and updates that help you know how far I am in the process of completing your order.

  2. All orders will include a sketch stage, line stage, coloring stage, and polish/final stage. I will be sending updates for each stage and will not continue to the next until the previous stage has been confirmed.

  3. I may also stream the process on my Twitch, but do let me know while ordering whether you would like me to keep the process private.

  4. Estimated time of delivery for your commission will vary between 1 - 3 weeks. This is dependent on how many pieces you are commissioning, the type of commissions are you are paying for, and sometimes life just happens, but again, I will be transparent with you the entire time.

__SECTION V. ORDERING A COMMISSION

So you've finally gotten to the last section of the contract. By now, I'm hoping you're invested in getting a commission done by me, but there are a few things that require that would help me get on the same page as you. Start by contacting me through DM's via Twitter, Facebook, or on discord @Omugiku#0492

  1. First, you must provide which of the 3 styles you would like done per piece commissioned. If there is any preference to how you would like your character posed, also list that.

  2. FOR ALL STYLES: You must provide references to the character you want drawn. References may be pictures, art, or sketches. This may also be in the form of a detailed written description of your character including colors for skin, hair, eyes, clothes, etc.

  3. FOR STYLE C: Banners may also just be backgrounds, but as stated before, I am only able to do simple backgrounds and objects. I still require a reference to what you would like drawn, whether they may be pictures, art, sketches, or a detailed description.

  4. Let me know whether you would like to be credited or not as the commissioner whenever I do post it. If you do, how would you want to be credited? Let me know if you would also allow me to stream the process through my Twitch.

  5. Payment means you have read and agreed to all of these terms.
